Terms of Service
Business customers only · Status: November 2026
1. Scope and parties
1.1 These Terms of Service ("Terms") govern the services provided by Yasmin Schwarze, trading as Answer To Go and Antwort to go, Albert-Einstein-Str. 47, c/o Autorenglück, 02977 Hoyerswerda, Germany ("we", "us") to the customer ("you").
1.2 Our services are offered exclusively to businesses (entrepreneurs within the meaning of § 14 German Civil Code (BGB), i.e. persons acting in their trade, business or profession), not to consumers. By ordering, you confirm that you order as a business.
1.3 Conflicting or deviating terms of the customer do not apply unless we expressly agree to them in writing.
2. Ordering, reseller and merchant of record
2.1 Subscriptions are sold through Lemon Squeezy (Sold through Link, LLC, formerly Lemon Squeezy, LLC, Salt Lake City, USA), which acts as our authorised reseller and merchant of record. The purchase and payment transaction takes place between you and Lemon Squeezy under Lemon Squeezy's buyer terms. Lemon Squeezy issues the invoice and handles payment, taxes, refund requests and payment disputes.
2.2 The provision of the services themselves is governed by these Terms. The contract for the services comes into effect when your order is completed at Lemon Squeezy's checkout.
3. Services
3.1 We set up and operate AI-supported reply assistants ("assistants") for the channels included in your plan (e.g. WhatsApp, e-mail, Facebook Messenger, Instagram, Google reviews), including configuration, training on your information and tone of voice, maintenance and the reports described in the plan.
3.2 The scope of each plan is described on our website at the time of ordering. Phone answering is not included.
3.3 We do not guarantee any particular result, such as revenue, bookings, response rates, reviews or ratings.
3.4 Medical and therapy practices, pharmacies and other businesses whose messages typically involve health data are currently excluded.
4. Onboarding and approval mode
4.1 After ordering, you complete our onboarding questionnaire and grant access to the booked channels via the platforms' official tools (e.g. Meta Business Suite, Google Business Profile manager role, e-mail delegation). You do not need to share passwords.
4.2 For the first 14 days the assistant runs in approval mode: it only drafts replies, and you approve each reply before it is sent. Afterwards replies are sent automatically unless you ask us to extend approval mode. Certain categories (e.g. negative reviews, complaints, payments, cancellations, unclear requests) are always forwarded to you.
5. Your obligations
5.1 You provide correct, complete and up-to-date information (e.g. prices, opening hours, booking rules, policies) and inform us promptly about changes.
5.2 You review draft replies during approval mode, grant and maintain the necessary access, and comply with the terms of the platforms you use.
5.3 You are responsible for the lawfulness of your own communication with your customers, including any required notices in your own privacy policy.
6. AI disclosure
Every assistant discloses in its first message that it is a digital/AI assistant and offers contact with a human (Art. 50 EU AI Act and applicable chatbot disclosure laws). You will not ask us to remove or conceal this disclosure.
7. Content and responsibility
The assistant answers only on the basis of the information you provided or approved. You are responsible for the accuracy of that information. We do not check the factual correctness of your information (e.g. prices, allergens, availability).
8. Platforms
The channels are operated by third parties (e.g. Meta, Google, your e-mail provider). Their terms and policies apply. Changes, outages, restrictions or account blocks by these platforms are outside our control. We only use official access routes.
9. Prices and payment
9.1 The prices shown at the time of ordering apply. For customers in Germany, prices are net plus statutory VAT; otherwise, applicable taxes are calculated by Lemon Squeezy at checkout.
9.2 Fees are charged monthly in advance via Lemon Squeezy.
9.3 WhatsApp conversation fees charged by Meta above Meta's free monthly allowance are passed on to you at cost.
9.4 We may change prices with at least 30 days' notice in text form, effective from the next billing period. You may cancel before the change takes effect.
10. Term and cancellation
10.1 The subscription runs month-to-month. You can cancel at any time, effective at the end of the current billing month, via the Lemon Squeezy customer portal or in text form (e-mail to hello@answertogo.com).
10.2 We may cancel with 30 days' notice to the end of a billing month. The right to terminate for good cause remains unaffected.
11. Liability
11.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.
11.2 For slight negligence we are only liable for breach of an essential contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible in the first place and on which you may regularly rely). In this case liability is limited to the typical, foreseeable damage and in any event to the total fees paid by you in the 12 months before the damaging event.
11.3 We are not liable for damage resulting from incorrect or incomplete information you provided, from replies you approved, or from measures taken by platform operators.
12. Data protection
Where we process personal data on your behalf, we act as your processor under Art. 28 GDPR. A data processing agreement (DPA) is available on request and forms part of the contract once concluded. Information about our own processing is set out in our privacy policy.
13. Changes to these Terms
We may amend these Terms with at least 30 days' notice in text form. If you do not object before the change takes effect, the amended Terms apply; we will point this out in the notice. If you object, either party may cancel.
14. Final provisions
14.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
14.2 If you are a merchant, a legal entity under public law or have no general place of jurisdiction in Germany, the exclusive place of jurisdiction is our place of business. We may also sue at your place of business.
14.3 Should any provision be invalid, the remaining provisions remain unaffected.
14.4 These Terms are available in English and German. In case of discrepancies, the German version (AGB) prevails.
